New trial date set in cemetery fraud case
HAMPTON --- A new trial date of Aug. 19 has been set for a couple charged with fraudulently operating a cemetery.

Albert and Mitzi Fenzloff, who are accused of theft and other charges related to the operation of Sunnyside Memory Gardens in Charles City, were to be tried March 18, but the trial was continued.

The trial is being held in Franklin County on a change of venue from Floyd County.

Sunnyside Memory Gardens, owned by the Fenzloffs since 2003, was put under state control because money was not put in trusts, memorials were not placed and the funeral home license was revoked.

Mitzi and Albert Fenzloff are charged with theft, fraudulent practice and ongoing criminal conduct, all in the first degree.
